Introduction
All content, materials, features, and functionality available on the ACM Track website (www.acmtrack.co.za), ACM Destiny platform (www.acmdestiny.net), Client Zone (clientzone.acmtrack.com), and associated mobile applications (collectively, the “Platform”) are owned by ACM Technology CC trading as ACM Track (“ACM Track”, “we”, “us”, or “our”) or our licensors. All such content is protected by South African and international copyright, trademark, patent, trade secret, and other intellectual property laws.
1. Copyright Ownership
1.1 ACM Track Owned Content
The following materials are the exclusive property of ACM Track and are protected by copyright:
- Website Content: All text, articles, product descriptions, technical documentation, and written materials
- Visual Content: Photographs, graphics, illustrations, icons, logos, images, and infographics
- Video Content: Marketing videos, tutorial videos, product demonstrations, hero videos, and promotional footage
- Audio Content: Voiceovers, sound effects, and audio recordings
- Software: ACM Destiny platform, mobile applications, web applications, APIs, and proprietary code
- Database Content: Product catalogues, pricing structures, technical specifications, and compiled data
- Design Elements: User interface designs, page layouts, colour schemes, typography, and visual branding
- Marketing Materials: Brochures, presentations, proposals, and advertising content
1.2 Third-Party Content
Certain content on the Platform may be owned by third parties and is used under applicable licences and permissions:
- Mapping Data: OpenStreetMap contributors (© OpenStreetMap contributors, licensed under ODbL)
- Vehicle Manufacturer Data: Make/model information and specifications used under fair use for product compatibility
- Stock Photography: Licensed from commercial providers where applicable
- Open Source Software: Used under respective licences (MIT, Apache 2.0, GPL — see Section 6)
- Payment Gateway Branding: PayFast logos and marks used with permission
- Hardware Manufacturer Content: Teltonika, Howen, and other OEM materials used with permission
2. Trademarks
2.1 ACM Track Trademarks
The following marks are trademarks or registered trademarks of ACM Track in South Africa. Visual marks — the ACM Track logo, ACM Destiny logo, and all associated design marks — are equally protected.
- ACM Track™ — Primary business name and service mark
- ACM Destiny™ — Telematics platform and fleet management software
- ACM Lite™ — Basic telematics service package
- ACM Advance™ — Premium telematics service package
- Limp Mode™ — Vehicle immobilisation feature
- ACM View™ — Camera/MDVR platform service name
- Client Zone™ — Customer portal platform
- ACMDeploy™ — Internal field operations platform (proprietary)
2.2 Third-Party Trademarks
The following trademarks are the property of their respective owners. Mention of these marks does not imply endorsement, affiliation, or sponsorship of ACM Track by those owners.
- Teltonika® — Teltonika UAB
- Howen® — Shenzhen Howen Technologies Co., Ltd.
- PayFast® — PayFast (Pty) Ltd
- Google Maps™ — Google LLC
- Android™ — Google LLC
- iOS® — Apple Inc.
- WhatsApp® — Meta Platforms, Inc.
2.3 Trademark Usage Restrictions
You may not do any of the following without our prior written consent:
- ✕Use ACM Track trademarks in your business name, product name, or domain name
- ✕Modify, alter, or create derivative versions of our trademarks
- ✕Use our trademarks in a way that suggests endorsement or affiliation
- ✕Register domain names, social media handles, or business names confusingly similar to our marks
- ✕Use our trademarks in meta tags, hidden text, or keyword fields for SEO purposes
3. Permitted Uses
3.1 Personal Use
You may access and use Platform content for:
- Personal Information: Researching our products and services for your own decision-making
- Educational Purposes: Learning about telematics, vehicle tracking, and fleet management
- Internal Business Evaluation: Evaluating our services for potential business use (non-commercial)
- Printing for Reference: Printing pages for personal, non-commercial reference
3.2 Existing Customers
If you are an active ACM Track customer, you may:
- Download Reports: Save and archive reports, data exports, and vehicle tracking information for your own vehicles
- Share Internally: Distribute Platform screenshots and data within your organisation for business operations
- Use in Presentations: Include ACM Destiny screenshots in internal business presentations
- API Integration: Use our APIs in accordance with your service agreement and API terms
3.3 Media & Press
Journalists and media may use:
- Company Logo: For articles and news stories about ACM Track (unaltered, with attribution)
- Product Screenshots: For reviews and editorial coverage (reasonable use, with attribution)
- Press Releases: Content from official ACM Track press releases (with attribution)
3.4 Attribution Requirements
When permitted use requires attribution, use the following formats:

4. Prohibited Uses
4.1 Strictly Forbidden Activities
The following are strictly prohibited without our prior written permission:
- ✕Copy or Reproduce: Download, copy, reproduce, or republish substantial portions of our website, software, or content
- ✕Commercial Use: Use our content for commercial purposes without a written licence agreement
- ✕Create Derivatives: Modify, adapt, translate, or create derivative works from our content
- ✕Reverse Engineer: Decompile, disassemble, or reverse engineer our software, applications, or APIs
- ✕Remove Attribution: Remove, obscure, or alter copyright notices, watermarks, or attribution
- ✕Competitive Use: Use our content, data, or software to create competing products or services
- ✕Scraping / Harvesting: Use automated tools (bots, scrapers, crawlers) to extract our content or data
- ✕Database Extraction: Copy our product catalogues, pricing databases, or compiled vehicle data
- ✕Resell or Redistribute: Sell, rent, lease, sublicence, or redistribute our content or software
- ✕Misrepresentation: Imply affiliation, endorsement, or authorisation that does not exist
- ✕Trademark Infringement: Use our trademarks in domain names, business names, or product names
- ✕Frame or Embed: Frame our website content or embed it in other websites without permission
4.2 Consequences of Violation
Violations of these restrictions may result in:
- Immediate termination of your service or Platform access
- Legal action for copyright or trademark infringement
- Claims for damages, interest, and legal costs on an attorney and own client scale
- Criminal prosecution where applicable under South African law, including the Copyright Act 98 of 1978 and the Cybercrimes Act 19 of 2020
5. User-Generated Content
5.1 Customer Data Ownership
You own your data. You retain all rights to data you upload to the Platform, including vehicle tracking data and GPS coordinates, camera footage and MDVR recordings, custom reports and saved configurations, and user profiles and account settings.
Our Licence: By uploading content, you grant ACM Track a non-exclusive, worldwide licence to store, process, and transmit your data to provide contracted services; display your data to authorised users in your organisation; analyse aggregate anonymised data for service improvement; and back up and secure your data in accordance with our Privacy Policy.
Your Responsibilities: You represent and warrant that you own or have the necessary rights to all uploaded content, that your content does not infringe any third-party intellectual property rights, and that your use complies with applicable laws, including POPIA and RICA.
5.2 Feedback & Suggestions
If you provide feedback, suggestions, or ideas (“Feedback”) to ACM Track:
- Feedback becomes ACM Track property without compensation to you
- We may use Feedback without restriction, obligation, or acknowledgement
- You waive any claims related to the implementation of your Feedback
- No confidential relationship is created by submitting Feedback
6. Software Licensing
6.1 Proprietary Software
Our proprietary software — including ACM Destiny, mobile applications, and Client Zone — is licensed to you, not sold. We grant you a limited, non-exclusive, non-transferable, revocable licence to use our software solely for accessing our services during your active subscription period.
Licence Restrictions. You may not:
- ✕Copy, modify, or create derivative works of the software
- ✕Reverse engineer, decompile, or disassemble the software
- ✕Rent, lease, lend, sell, sublicence, or transfer the software to any third party
- ✕Use the software for service bureau or time-sharing purposes
- ✕Remove or modify any proprietary notices, labels, or copyright marks in the software
Your licence terminates automatically upon breach of these terms or upon cancellation or expiry of your service agreement.
6.2 Open Source Components
Our software incorporates open source components under the following licences. We comply with all obligations of each licence, including preserving copyright notices, providing source code where required, and including licence texts in distributions.
- MIT Licence — Various JavaScript libraries and front-end frameworks
- Apache Licence 2.0 — Android components and mapping libraries
- GPL v3 — Specific server-side components where applicable
6.3 API Terms
Use of ACM Track APIs is governed by these Copyright terms, our API Terms of Service, and your Service Agreement. APIs are available to authorised customers only and may not be used to:
- ✕Create competing services or products
- ✕Aggregate data for commercial resale to third parties
- ✕Bypass usage limits, rate limits, or security measures
- ✕Access data outside your authorised scope or organisation
7. Copyright Infringement Reporting (South African Law)
7.1 Reporting Copyright Infringement
If you believe content on our Platform infringes your copyright under the South African Copyright Act, 1978 (Act No. 98 of 1978), submit a written notice to our Copyright Agent:
7.2 Required Information in Notice
Your notice must include all of the following:
- 1.Your full contact information: name, address, telephone number, and email address
- 2.Identification of the copyrighted work you claim has been infringed, including evidence of ownership
- 3.Identification of the infringing material: URL or specific location on our Platform with sufficient detail for us to locate it
- 4.A statement of good faith: "I have a good faith belief that the use of this material is not authorised by the copyright owner, its agent, or the law"
- 5.A statement of accuracy: "The information in this notice is accurate and I am authorised to act on behalf of the copyright owner"
- 6.Your physical or electronic signature
7.3 Response Process
Upon receiving a valid notice, we will:
- Acknowledge receipt and begin investigation within 7 business days
- Remove or disable access to infringing material if the claim is substantiated
- Notify the alleged infringer of the removal
- Restore content if a valid counter-notice is received
7.4 Counter-Notice Procedure
If your content was removed and you believe that removal was in error, you may submit a counter-notice to legal@acmtrack.co.za that includes:
- 1.Your full contact information
- 2.Description of the removed material and its original location on the Platform
- 3.A sworn statement: "I have a good faith belief that the material was removed in error"
- 4.Consent to the jurisdiction of the High Court of South Africa for any dispute
- 5.Your physical or electronic signature
7.5 Repeat Infringers
In accordance with our obligations under applicable law and our own policy, users who are found to repeatedly infringe third-party copyright will have their Platform access and service accounts terminated without refund.
8. International Considerations
8.1 Primary Jurisdiction
ACM Track operates primarily in South Africa. Our intellectual property rights are protected under:
- Copyright Act, 1978 (Act No. 98 of 1978) — South African copyright law
- Trade Marks Act, 1993 (Act No. 194 of 1993) — South African trademark law
- Berne Convention — International copyright treaty to which South Africa is a signatory
- Paris Convention — International trademark protection treaty
8.2 Cross-Border Use
If you access the Platform from outside South Africa:
- You are responsible for compliance with your own local laws regarding intellectual property
- Our South African intellectual property rights remain fully enforceable
- South African law governs all copyright and trademark disputes arising from use of the Platform
- Export and import restrictions may apply to certain software components depending on your jurisdiction
9. DMCA — US-Based Users
9.1 DMCA Safe Harbor
Although ACM Track is a South African company, we respect the provisions of the US Digital Millennium Copyright Act (DMCA) for US-based users accessing our Platform.
9.2 DMCA Takedown Notices
US-based copyright holders may submit DMCA-compliant takedown notices following the same procedure set out in Section 7 above. Notices that do not substantially comply with the requirements of 17 U.S.C. § 512(c)(3) may not receive a response.
10. Updates & Changes
10.1 Right to Modify
We reserve the right to at any time and without prior notice:
- Update, modify, or remove Platform content
- Change copyright notices and intellectual property statements
- Modify software licences and associated terms
- Update third-party attributions as licences or permissions change
10.2 Notice of Changes
Material changes to this Copyright page will be:
- Posted with an updated "Last Updated" date at the top of this page
- Announced via email to active customers for significant changes
- Effective immediately upon posting unless stated otherwise
